What is Foreign Discovery?

One area where Bombard Law Office, PC can assist is with foreign discovery. That is when there is a lawsuit in another state, but there is discovery needed from a Massachusetts entity. That entity is not a party to the lawsuit but has information that is needed.


For example, I recently assisted a New York firm that needed a subpoena served on a Massachusetts company related to a New York lawsuit. That Massachusetts company was not a party to the New York case, but it had relevant documents. The New York firm couldn’t issue a subpoena on a Massachusetts company for a New York case.


The process is straight forward. I filed a case in superior court to have the court issue and authorize a subpoena on the Massachusetts company. I filed the complaint and a draft example of the subpoena. The superior court then approved the form and issued the subpoena, which was subsequently served.
